Mediation Fails in IndiGo-Mahindra 6E Trademark Dispute, Case Moves to Trial

Mediation between IndiGo and Mahindra over the “6E” trademark has failed, with the case now moving to trial. Mahindra has rebranded its SUV but continues to contest IndiGo’s claims.

Efforts to resolve the trademark dispute between InterGlobe Aviation Ltd, which operates IndiGo, and Mahindra Electric Automobile Ltd over the use of the “6E” mark have failed, with the matter now set to proceed to a full trial. 

The Delhi High Court, in an order dated 31 October and made public recently, recorded that mediation between the two companies did not result in a settlement.

The case was heard by joint registrar (judicial) Sudhir Kumar Sirohi, who directed both parties to submit photocopies of all relevant documents along with a joint schedule. 

The next hearing is scheduled for 3 February 2026, when the court will address the admission and denial of documents before moving to the trial stage, where evidence and arguments will be examined to determine if Mahindra’s use of “6E” for its electric vehicle infringes IndiGo’s trademark rights.

The dispute began when IndiGo filed a trademark infringement suit in December 2024, objecting to Mahindra’s plan to name its new electric SUV “BE 6E.” IndiGo argued that “6E” is a distinctive part of its brand, used in services like 6E Prime, 6E Flex, and 6E Rewards, and is registered under several trademark classes, including advertising, transport, and printed materials.

In response, Mahindra provided an undertaking to the court in December 2024, stating it had renamed the vehicle to “BE 6” and would not use the “6E” mark while the case is ongoing. 

However, Mahindra continues to contest IndiGo’s claims, arguing that its “BE” brand is registered under a different class for automobiles and that the original “6E” was a playful reference to “Be Sexy.” The company also questioned whether short alphanumeric marks should be monopolised.

Since the rebranding, Mahindra’s BE 6 and XEV 9e have seen strong sales, with over 20,000 units sold within five months of launch.
