In a move that could significantly impact both vehicle owners and the fight against pollution in Delhi-NCR, the Supreme Court is set to hear a vital plea on July 28 regarding the end-of-life restrictions imposed on BS VI-compliant vehicles. The case, scheduled before a bench comprising Chief Justice B R Gavai and Justice K Vinod Chandran, will address the legality and rationale behind treating newer, cleaner vehicles on par with older models under existing disposal rules.

The roots of this legal challenge go back to 2015, when the National Green Tribunal (NGT) ordered a ban on diesel vehicles older than 10 years and petrol vehicles older than 15 years in the National Capital Region (NCR) to tackle rampant air pollution. The Supreme Court upheld this directive in 2018. More recently, as the Delhi government issued a directive barring fuel supply to such end-of-life vehicles at petrol stations, significant public outcry led to a temporary suspension of the order.

With the implementation of Bharat Stage VI (BS VI) emission norms from April 2020, India’s vehicles now meet the most stringent pollution control standards ever enforced in the country. BS VI vehicles emit 80% less particulate matter and 70% less nitrogen oxides compared to their BS IV counterparts, which were common when these bans were originally formulated.

Petitioners argue that continuing to apply a blanket 10-year (diesel) and 15-year (petrol) age cap on BS VI vehicles, despite their cleaner technology, lacks scientific basis and fairness. They contend that these rules were set in “a different environmental context,” and enforcing them without consideration of modern advancements could force non-polluting, roadworthy vehicles off the roads. They further highlight that such policies may disproportionately affect middle-class and lower-income citizens who depend on well-maintained used vehicles for affordable transport.

Petitioners also emphasise that any change to the policy must come through judicial review, not unilateral government action, referencing prior Supreme Court and NGT orders on air quality and emission control.

The upcoming hearing will likely set a precedent for how India balances technological progress in emissions control with urgent public health concerns. If the Court finds merit in the plea, BS VI vehicle owners in the NCR could gain reprieve from mandatory scrapping after the current age limits, marking a shift toward policies based on scientific vehicle fitness and emissions rather than age alone.
